Sold my FAL bought a Bushmaster 24
 
So, I made a quick $200 on the FAL, never even shot it lol. But I really wanted a long range ar, so I found a brand new Bushmaster Varminter. Won't have it until next week, but i am picking it up and going strait to the range.

Anyone have a Bushmaster Varminter?

No laws were broken unless he was a felon, or lied on the Federal form when he purchased it, or knowingly bought it stolen, or for some other reason could not legally own that rifle in his state. There is no law that says you must hold a firearm for a given length of time before you can resell. People can sell or trade any firearm (most states) the same day they purchase it. Happens thousands of times every weekend at gunshows across the country. The BATF isn't interested unless they can prove you are trafficking in firearms without a license.

I've been told that they will call you a "dealer" if you sell more than a certain number of firearms in a year (like, 6?). They have been known to make the case that an individual purchased a firearm with the intent of reselling it for a profit (dealer - "engaged in the BUSINESS of...") by virtue of the fact that the firearm was unused.

My dealer would have told me if I were going to get in trouble he's pretty on top of that stuff. Basically I bought the FAL had it send to my FFL, he said "hey I don't know how much you want that FAL, but I know a guy who wants one, you could make a couple bucks" I paid $525 for the FAL plus $25 shipping, I said screw it, if he will give me $750 I'll do it. Thinking the dude wouldn't pay that, well he did. The gun never left my dealers safe (I did go by and look at it). So really I don't even know if I technically owned it as I never paid him for the background check or anything (no firearm registration here).

I know he does it all the time, someone will buy something and he knows someone who has been looking for that gun for a while and he works out a deal.

There's no timeframe, the straw purchase law would be if I put that I was the buyer on the background check, then handed it over to someone who could not legally own a gun. Since they don't register guns in florida it's pretty much Wild West style anyway. You can do a face to face transfer, no paperwork, no background check not even a copy of their drivers license as long as you don't "think" the buyer is a felon.

I've sold maybe 3 guns in my whole life, I rarely sell them and each time I have done it through my dealer so that I don't have to stress about selling it to some ex-con or serial killer.

You got rid of a FAL to get a freakin' AR? BLASPHEMY!! I hope it was a Century FrankenFal at least, but even that is no consolation to my shattered heart. My BIL made a couple 300 yard headshots with his Century FAL last week at the range. With irons.

Oh please no .223 vs. .308 battle. It was a Hesse Fal and it was heavy, for long range and hunting purposes I'd much rather have the Varmint .223, but to each his own.
